Terms and Conditions
GENERAL INFORMATION
Welcome to Rentaware. These Terms and Conditions govern the contractual relationship between Rentaware (hereinafter ‘the Company’, ‘we’, ‘us’ or ‘our’) and the users or customers (hereinafter ‘User’, ‘Customer’, ‘you’ or ‘your’) who contract our hardware leasing services.
By using our services, you agree to be bound by these Terms and Conditions. We recommend that you read them carefully before contracting any service.
1. SUBJECT OF THE CONTRACT
1.1. Rentaware offers hardware and technological equipment leasing services for companies and professionals.
1.2. The service includes the temporary rental of the selected equipment, technical maintenance, support and, depending on the contracted plan, technological renewal.
1.3. The equipment provided by Rentaware is the property of the Company and is rented to the Customer for the contracted period.
2. CONTRACTING PROCESS
2.1. In order to contract our services, the Client must be of legal age and have the legal capacity to enter into contracts.
2.2. The contracting process will be carried out via our website, by telephone or in person, and will be formalised by signing a specific contract.
2.3. Rentaware reserves the right to request additional documentation to verify the identity and creditworthiness of the Customer.
3. DURATION OF THE CONTRACT
3.1. The minimum duration of the contract is 12 months, unless otherwise specified in the particular offer.
3.2. At the end of the contracted period, the Client may:
a) Renew the contract with the same equipment.
b) Renew the contract with new equipment (subject to the conditions of technological renewal).
c) Terminate the contractual relationship, returning the equipment in good condition.
4. ECONOMIC CONDITIONS
4.1. The price of the service is established in the form of a monthly fee, depending on the plan and equipment selected.
4.2. Payments shall be made by direct debit within the first 5 days of each month.
4.3. Late payment will generate a late payment interest of 0.025% per day, without prejudice to any other legal action that may be applicable.
4.4. Rentaware may revise the prices annually in accordance with the CPI or due to significant changes in the market, notifying the Customer at least 30 days in advance.
5. DELIVERY AND RETURN OF EQUIPMENT
5.1. Rentaware undertakes to deliver the equipment to the place designated by the Customer within the agreed period.
5.2. At the time of delivery, a check will be carried out to ensure that the equipment is in good working order.
5.3. At the end of the contract, the Client must return the equipment in good condition, taking into account normal wear and tear.
5.4. If the equipment shows damage not attributable to normal use, Rentaware may invoice the cost of repair or replacement.
6. MAINTENANCE AND TECHNICAL SUPPORT
6.1. Rentaware will provide maintenance and technical support according to the conditions of the contracted plan.
6.2. The Customer must report any incident through the established channels (telephone, email or customer area).
6.3. The response time will vary according to the severity of the incident and the contracted plan.
6.4. Maintenance does not cover damage caused by misuse, accidents, natural disasters or unauthorised hardware modifications.
7. LIMITATION OF LIABILITY
7.1. Rentaware shall not be liable for indirect damage, loss of profit or loss of data resulting from the use of the equipment.
7.2. Rentaware’s maximum liability in the event of default shall not exceed the total amount paid by the Customer in the last 12 months.
7.3. The Customer is responsible for making regular backup copies of its data.
8. OBLIGATIONS OF THE CUSTOMER
8.1. Use the equipment in accordance with the technical specifications and manuals provided.
8.2. Not to make unauthorised hardware modifications or software installations that may affect the performance or security of the equipment.
8.3. To allow access to the equipment for maintenance work when necessary.
8.4. Not to assign or sublet the equipment to third parties without prior written authorisation from Rentaware.
9. DATA PROTECTION
9.1. The Customer’s personal data will be processed in accordance with our Privacy Policy and current data protection legislation.
9.2. Rentaware implements appropriate technical and organisational measures to ensure data security.
10. TERMINATION OF THE CONTRACT
10.1. Rentaware may terminate the contract in the event of:
a) Non-payment of two consecutive instalments.
b) Improper use of the equipment.
c) Serious breach of any other contractual obligation.
10.2. Early termination for causes attributable to the Customer will entail the payment of a penalty equivalent to 50% of the outstanding instalments until the termination of the contract.
11. MODIFICATIONS TO THE TERMS AND CONDITIONS
11.1. Rentaware reserves the right to amend these Terms and Conditions.
11.2. Modifications will be notified to the Customer at least 15 days prior to their entry into force.
11.3. If the Customer does not agree with the modifications, the Customer may terminate the contract without penalty within 15 days of notification.
12. APPLICABLE LAW AND JURISDICTION
12.1. These Terms and Conditions are governed by Spanish law.
12.2. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the domicile of the Client, unless otherwise provided by law.
13. COMMUNICATIONS
13.1. Communications between the parties shall be made preferably by electronic means, to the email addresses provided.
13.2. It is the Client’s responsibility to keep their contact information up to date.
14. FINAL PROVISIONS
14.1. If any provision of these Terms and Conditions is declared invalid or unenforceable, this shall not affect the validity of the remaining provisions.
14.2. Failure by Rentaware to require strict compliance with any of the obligations does not imply a waiver of the right to require such compliance in the future.
